Probate Conservatorships: What Britney and Gramps Papa Have in Common

This article in the Entertainment Law Digest shows the seriousness and legal effect of conservatorship proceedings.  It involves the sad story of Britney Spears - who apparently was truly in need of a conservatorship.

Whether the issue is an immature pop princess or the far more common situation of an ailing parent or family elder, the issues are actually very similar.  If the person appears to have lost mental capacity, decision making ability, and is capable of hurting themselves and others, then conservatorhships are truly appropriate - and can be formed by probate courts.

Just as Britney had her car taken away, it is appropriate for ailing elders to have their cars taken when it is beneficial for them and others on the road.

Just as Britney had her checkbook and credit cards taken awaey, it is likewise appropriate for ailing elders to have their spending ability taken away.

The issue is never one of attempting to control our respected elders, but rather of protecting the integrity of elders who have reached a stage where they truly need … and would want protection from family, a caring probate attorney, and the probate court.

Our ailing elders in their right frame would never think of buying beachfront property in Kansas.  They would want their trusted loved ones to protect them from doing so in any vulnerable state.

Probate Attorneys not only handle wills, will contests, intestate proceedings for family members who have passed; they also handle conservatorship proceedings like the one discussed above.
